2. 정의

학교 내 체벌은 20세기 후반과 21세기 초에 걸쳐 다양하게 정의되어 왔다. 예를 들어, "아동의 바람직하지 않은 행동 혹은 언행에 대해 의도적으로 고통을 주는 것[240]", "학생의 용납할 수 없는 행동에 대해 교육 기관 당사자에 의해 처벌로서 의도적으로 가해지는 신체적 고통이나 불쾌감[241]", "행동을 바꾸는 수단으로서 의도적으로 육체적 고통을 주는 것(당면한 위험으로부터 학생이나 다른 사람을 보호하기 위해 일시적으로 신체를 구속할 목적으로 사용하는 것이 아님)[242]"과 같은 것들이 있다.

3. 역사

학교 체벌은 오랜 역사를 지니고 있으며, 과거 전 세계적으로 널리 사용되었다. 특히 서구 사회에서는 19세기와 20세기에 학교 체벌이 훈육의 주요 수단으로 여겨졌다. 영어권 국가들의 학교 체벌 문화는 19세기와 20세기에 영국에서 10대 소년에게 곤장을 때리는 관습에서 비롯된 것이다.[245] 조지 크루크생크가 그린 학교에서의 곤장 그림(1839년)은 이러한 시대상을 반영한다.

1917년 러시아 혁명 이후, 소련에서는 체벌이 공산주의 이념에 반하는 것으로 여겨져 금지되었다.[18] 다른 공산주의 국가들도 비슷한 조치를 취했다. 예를 들어, 2007년 조선민주주의인민공화국 학생들은 체벌을 알지 못했다.[20] 중국에서는 1986년 학교 체벌이 금지되었지만,[21] 농촌 지역에서는 여전히 흔하게 행해지고 있다.[22]

20세기 후반부터 아동 권리에 대한 인식이 높아지면서 학교 체벌에 대한 비판이 확산되기 시작했다. 그리스에서는 1998년 초등학교, 2005년 중등학교에서 체벌이 금지되었다.[408] 영국은 1987년 공립학교,[14][15][16] 1998년 사립학교에서 체벌을 금지했다.[17] 현재 유럽, 남미 대부분, 캐나다, 일본, 남아프리카 공화국, 뉴질랜드 등 128개 국가에서 학교 체벌이 금지되었다.

반면, 싱가포르, 말레이시아, 일부 아프리카 국가에서는 남학생에게 매질을 하는 경우가 여전히 존재한다. 미국의 경우, 대부분의 주에서 주립 학교 체벌을 금지했지만, 남부 주에서는 여전히 허용되고 있다.[12] 2008~2009학년도에 21만 6천 명 이상의 미국 학생들이 체벌을 받았다.[13] 태국처럼 법적으로는 체벌이 금지되어 있지만, 실제로는 널리 행해지는 국가도 있다.

미국 소아과 학회(AAP)에 따르면, 학교 체벌의 근거는 종교적 전통, 징계 철학, 교사의 필요와 권리라는 세 가지로 나뉜다.[10] 그러나 AAP는 체벌이 다른 행동 관리 방법보다 효과적이지 않으며, 오히려 공격성 증가, 학습 환경 악화 등 부정적인 결과를 초래할 수 있다고 지적한다.[10]

3. 1. 한국의 학교 체벌 역사

한국에서도 학교 체벌은 오랫동안 교육 현장에서 널리 사용되어 왔다. 조선시대 서당에서부터 근현대 학교에 이르기까지, 체벌은 학생들을 통제하고 훈육하는 주요 수단으로 여겨졌다. 특히, 일제강점기에는 일본의 군국주의 교육 방식의 영향으로 학교 체벌이 더욱 강화되었다.

해방 이후에도 학교 체벌은 계속되었으며, 1960년대와 1970년대에는 교사에 의한 과도한 체벌이 사회 문제로 대두되기도 하였다. 1966년 5월 서울시내 국·공·사립학교 교장단은 '일체의 체벌 금지'를 결의하였고,[413][414] 1979년 문교부(현 교육부)는 생활지도지침을 통해 각 학교 내 체벌, 폭언, 기타 단체기합을 금지하였다.[415] 그러나 20세기 말까지 체벌 금지가 법령이나 교육부 자체 기준으로 정해져 있지 않았기 때문에, 대한민국 내 초,중,고등학교에서는 학생을 향한 교사의 직접적 체벌이 만연했으며, 이 중에서는 그 수위가 심각해 사회적 문제가 되기도 하였다.

1980년대 민주화 운동 이후 학교 체벌에 대한 비판적인 여론이 형성되기 시작했으며, 1990년대 이후 학교 체벌 금지를 위한 시민 사회의 노력이 본격화되었다. 2002년 교육인적자원부에서 교사들이 체벌 시 사용하는 회초리 규격을 발표하면서 논란이 되기도 하였으며, 2005년에는 MBC 100분 토론에서 체벌에 대한 찬반토론이 벌어졌다. 당시 가수 신해철이 체벌을 반대하는 측으로 출연하기도 했다.

2000년대 중반 카메라 기능이 달린 휴대폰의 등장 및 인터넷으로 인하여 학생들이 체벌 장면을 찍어 올리는 일이 늘어나게 되자 체벌은 점차 수위가 낮아지고 줄어들어 가기 시작했다. 2010년 7월 서울 동작구의 한 초등학교 6학년 담임교사가 남학생을 심하게 폭행하는 일명 '오장풍 교사 사건' 이 일어나 한국 사회에 충격을 주었다. 이 담임교사는 이전에도 학생들을 심하게 체벌하는 것으로 유명한 교사였는데, 특히 혈우병을 앓고 있어 멍이나 상처에 민감할 수 밖에 없는 학생을 심하게 체벌하여 더욱 논란이 되었다. 해당 담임교사는 직위해제되었으며, 이 사건을 계기로 교육계에서도 체벌금지에 대한 본격적인 공론화가 이루어졌고, 2011년 3월에 초중등교육법이 개정 후 시행되면서 (교사가 학생을 직접 때리는) 직접적 체벌은 2011년 2월까지만 허용되었고, 2011년 3월부터는 직접적 체벌이 아닌 간접적 체벌만 허용되었다.

2010년 경기도 교육청을 시작으로 진보 성향의 교육감들이 당선되면서 학교 체벌 전면 금지 조치가 시행되었고, 2012년 3월부터는 체벌이 완전히 금지되었다. 현재 서울특별시, 강원도, 경기도, 전라북도, 전라남도, 광주광역시에서는 교육감의 권한으로 모든 체벌이 금지되어 있다.[416][417]

4. 정당성 및 비판

학교 체벌은 그 정당성에 대해 여러 논쟁이 있다.

체벌 지지 측은 체벌이 즉각적인 효과를 가져다주며, 정학보다 낫다고 주장한다. 반면 반대 측은 체벌이 학생들의 행동을 긍정적으로 관리하는 데 효과가 없고, 여러 부정적인 결과를 초래한다고 주장한다. 여러 국제 인권 단체들은 체벌이 아동의 인권을 침해한다고 비판한다.[396][36][37][38]

미국에서 체벌을 받은 학생 중 1~2%는 의료 처치가 필요한 심각한 상해를 입는다. 여기에는 타박상, 찰과상, 골절, 채찍질, 근육 손상, 뇌좌상, 심지어 사망까지 포함된다.[241][242] "좌골 신경 손상[241]", "광범위한 혈종", "생명을 위협하는 지방 내 출혈[242]"과 같은 상해 사례도 보고되었다.

청소년 의학회는 학생의 능력에 맞는 자극적인 교육, 다양한 비폭력 행동 수정 기법, 학교 문제에 대한 결정에 학생과 학부모를 참여시키는 것을 권장한다. 또한 학생 자치 운영이 교실 내 방해 행위를 관리하는 효과적인 대안이 될 수 있다고 제안한다.[11]

미국 소아과 학회(AAP)는 체벌 폐지 이후 학교에서 징계 문제가 증가했다는 보고는 없다고 언급했다.[10]

4. 1. 지지 측 주장

학교 체벌 지지자들은 체벌이 해이해진 기강에 즉각적인 효과를 줄 수 있다고 주장한다. 또한, 정학 처분보다 학생들이 바로 수업에 참여할 수 있다는 점에서 체벌이 더 낫다고 주장한다.[396]

4. 2. 반대 측 주장

몇몇 연구에 따르면, 학교 체벌은 학생들의 행동을 관리하는 긍정적인 방법으로서 효과가 크지 않다.[396] 학교 체벌은 육체적, 정신적, 교육적으로 부정적인 결과를 초래할 수 있는데, 예를 들면 공격적이고 파괴적인 행동, 수업 방해 행동, 반달리즘 증가, 학업 부진, 집중력 저하, 중퇴 증가, 등교 거부나 학교 혐오, 자존감 저하, 불안, 신체적 불편, 우울, 자살, 교사에 대한 보복 등이 있다.[396]

의학, 소아과, 심리학 단체들은 교내 체벌에 반대한다.[397][398][399][400][401][402][403][404][405][406][407] 미국 소아과 학회(AAP)는 학교에서의 체벌이 학생들 사이에서 폭력이 타인의 행동을 관리하는 적절한 수단이라는 인상을 심어줄 위험이 있다고 경고한다.[10] 미국 아동 청소년 정신의학회는 "체벌은 아이에게 대인 관계 갈등을 해결하는 방법이 물리력을 사용하고 고통을 가하는 것이라고 신호를 보낸다"라고 말한다.[9] 청소년 의학회는 "학교에서의 체벌은 폭력이 우리 사회에서 용납될 수 있다는 매우 불안정한 메시지를 전달하며, 아이들에게 폭력을 가하는 것이 칭찬할 만한 일이라는 생각을 허용함으로써 사회적으로 아이들의 가치를 떨어뜨린다"라고 말한다.[11]

유엔 아동 권리 위원회, 유럽 평의회 의회, 미주 인권 위원회를 포함한 여러 국제 인권 단체는 모든 종류의 신체적 처벌이 아동의 인권을 침해한다고 밝혔다.[36][37][38] 아동 권리 위원회는 "어린이는 학교 정문을 통과한다고 해서 인권을 잃지 않는다"라며, 체벌은 어린이의 존엄성을 존중하지 않는 행위라고 비판한다.[39]

5. 학생에 대한 영향

5. 3. 사회적 영향

체벌은 학생들에게 폭력이 문제 해결의 수단이라는 왜곡된 인식을 심어주고, 폭력적인 행동을 모방하게 만들 수 있다는 사회적 우려가 제기된다.[36][37][38]

유엔 아동 권리 위원회는 아동 권리 협약 제19조를 근거로 "어린이는 학교 정문을 통과한다고 해서 인권을 잃는 것이 아니다"라며 체벌이 아동의 존엄성을 침해한다고 지적한다.[39] 이 조항은 아동이 모든 형태의 신체적, 정신적 폭력으로부터 보호받아야 함을 명시한다.

6. 대안

학교 체벌의 대안으로 여러 국제 인권 단체들은 체벌 금지를 제시한다. 유엔 아동 권리 위원회, 유럽 평의회 의회, 미주 인권 위원회 등은 모든 종류의 신체적 처벌이 아동의 인권을 침해한다고 밝혔다.[36][37][38]

아동 권리 위원회는 "어린이는 학교 정문을 통과한다고 해서 인권을 잃지 않는다... 체벌을 사용하는 것은 어린이의 고유한 존엄성이나 학교 규율에 대한 엄격한 제한을 존중하지 않는다"라고 언급했다.[39] 아동 권리 협약 제19조는 모든 형태의 체벌 금지를 의미하며, 회원국에 아동 보호를 위한 적절한 조치를 취할 것을 요구한다.

유럽 사회 권리 위원회와 아프리카 아동 권리 및 복지 전문가 위원회 또한 학교를 포함한 모든 환경에서 아동에 대한 체벌 금지를 지지하며, 2009년 아동 권리 및 이슬람 법학에 관한 카이로 선언에서도 학교 및 기타 장소에서 체벌 금지 의무가 확인되었다.[40]

7. 국제 인권 규범

여러 국제 인권 기구는 모든 형태의 신체적 처벌이 아동의 인권을 침해한다고 명시하고 있다. 특히, 유엔 아동 권리 협약 제19조는 당사국이 아동을 모든 형태의 신체적, 정신적 폭력으로부터 보호하기 위한 조치를 취할 것을 의무화하고 있다.[75][308]

2014년 볼리비아는 학교를 포함한 모든 환경에서 체벌을 금지했다. 아동 및 청소년법에 따르면 "아동 및 청소년은 비폭력적인 양육과 교육을 포함한 좋은 대우를 받을 권리가 있다... 모든 신체적, 폭력적, 굴욕적인 처벌은 금지된다."[75]

브라질에서는 2014년에 학교를 포함한 모든 국면에서의 체벌이 금지되었다. 1990년의 개정 아동 청소년법에서는 "아동 및 청소년은 교정·훈육·교육 그 외 어떠한 명목으로도 체벌 또는 학대, 혹은 품위를 떨어뜨리는 취급을 받지 않고 교육을 받을 권리를 가진다"고 명시하고 있다.[308]

8. 각국의 현황

2023년 기준으로 전 세계 128개국에서 학교 체벌을 법으로 금지하고 있다. 학교 체벌은 세계 각국의 학교에서 일반적으로 사용되었지만, 최근 수십 년 간 유럽과 캐나다, 일본, 남아프리카 공화국, 뉴질랜드 등 여러 나라에서는 금지되었다. 반면, 아프리카와 동남아시아, 중동의 몇몇 국가들에서는 여전히 시행되고 있다.

영어권 국가에서 학교 체벌은 19세기와 20세기 영국에서 10대 청소년들을 체벌한 것과 관련이 깊다.[390] 미국 남부에서는 여전히 회초리가 사용되지만, 최근 20년 간 그 빈도는 급격히 줄었다.

1917년 러시아 혁명 이후, 러시아와 소련에서는 공산당의 이상과 반대로 학교 체벌이 금지되었다.[391] 유럽을 찾은 소련 방문객들은 유럽 학교의 체벌에 충격을 받기도 했다.[392] 다른 공산주의 정권에서도 이를 따랐는데, 북한의 경우 현재 학교 체벌이 금지되어 있고,[393] 공식적으로는 중국에서도 그러하다.[394] 한편, 영국과 같은 다른 국가들의 공산주의자들은 학교 체벌을 '자본주의' 교육 체제의 타락의 증상이라고 주장하며 반대 운동을 벌였다.[395]

대한민국에서는 20세기 말까지 체벌 금지가 법령이나 교육부 자체 기준으로 정해져 있지 않아 학교에서 교사의 직접 체벌이 만연했다. 그러나 2000년대 중반 카메라폰과 인터넷의 등장으로 체벌 장면이 공개되면서 점차 수위가 낮아지고 줄어들었다. 2010년 '오장풍 교사 사건'을 계기로 교육계에서 체벌 금지에 대한 공론화가 이루어졌고, 2011년 3월부터 직접 체벌이 금지되었다. 2012년 3월부터는 체벌이 완전히 금지되었다.

8. 1. 아시아

말레이시아에서는 2006년에 학교 체벌을 불법으로 규정했으나[411], 여전히 행해지고 있다. 헌법상 금지되어 있지만, 현재 공립학교나 사립학교 등에서 많이 사라졌다. 동의서를 쓰면 제한적으로 허용되기도 하지만, 일부 중국계 학교들에서 간혹 체벌이 행해지는 경우도 있다. 코타키나발루의 한 중국계 학교에서는 교사가 여학생 화장실에 들어간 남학생의 따귀를 때려 물의를 빚은 사건도 있었다.

다른 나라들과 마찬가지로 명확한 증거가 없거나 비밀리에 체벌이 이루어지면 법적 처벌이 어렵다. 기관들의 부패로 인해 제대로 해결되지 않는 경우도 많다. 체벌을 안 하는 추세이지만, 가끔 앉았다 일어서기나 햇볕이 강한 낮에 운동장 한가운데 세워두는 경우도 있다.

하지만 암팡자야나 몽키아라 등 한국계에서는 도를 넘는 체벌이 행해지며, 한국계 학원들은 이를 노골적으로 행하고 있다.

싱가포르 학교에서는 남학생에 대한 체벌이 합법이며, 정부는 엄격한 훈육을 위해 전적으로 지지한다.[425] 체벌에는 가벼운 등나무 회초리만 사용할 수 있다.[426] 체벌은 신중하게 고려된 후 공식적인 행사에서 집행된다. 대부분의 중고등학교와 일부 초등학교에서 잘못을 저지른 학생에게 회초리를 사용한다.[427] 중고등학교 이상에서는 엉덩이를 때리며, 교육부에서는 건당 최고 6대로 규정하고 있다. 경우에 따라서는 다른 학생들 앞에서 체벌을 집행하기도 한다.

인도에서는 학교 체벌이 여전히 행해지고 있다. 2000년에 인도 대법원에서 학교 체벌을 금지했고, 28개 주 중에서 17개 주가 이를 적용하겠다고 했으나, 집행은 엄격하지 않다.[442]

일본에서는 1947년에 체벌이 금지되었으나, 일부 학교에서는 2000년대 이전까지 학교 체벌이 있었다. 1987년에는 약 60%의 중·고등학교 교사들이 체벌이 필요하다고 여겼고, 7%는 반드시 필요하다고 믿었다. 59%는 때때로 체벌이 주어지고 있다고 여겼고, 32%는 모든 상황에서 체벌을 좋지 않게 생각하였다. 초등학교에서는 2%가 학교 체벌을 무조건적으로 지지했고, 47%는 필요성을 인정하였고, 49%는 인정하지 않았다.

중국에서는 1949년 공산 혁명 이후로 교내 처벌이 금지되었다. 실제로는, 일부 학교에서 학생들이 막대와 곤장으로 매를 맞는다.[443][444]

타이완에서는 2005년 학생 체벌에 대한 교육부 규정으로 학교 체벌이 금지되었다.[453]
