3. 상설중재재판소(PCA) 중재 절차

상설중재재판소(PCA)는 2015년 10월 29일 필리핀이 제기한 15개 청구 항목 중 다음 7개 항목에 대해 관할권이 있다고 결정하고, 2015년 11월 중국이 불참한 가운데 구두변론을 진행했다.^[12]

필리핀이 남중국해 분쟁을 상설중재재판소에 제소한 것에 대해 지지 또는 반대 의사를 표명한 국가 및 다국적 기구들이 있지만, 이들이 분쟁 지역의 소유권과 관련하여 어느 한쪽의 입장을 지지하는 것은 아닐 수 있다.^[55][56][57]

2016년 F-Secure에 따르면, 해커들이 필리핀 법무부와 헤이그에서 필리핀을 대리했던 국제 법률 회사에서 기밀 정보를 빼냈으며, 해킹이 중국 정부의 지원을 받았을 가능성이 높다고 밝혔다.^[146]

학자 그레이엄 앨리슨은 2016년에 "유엔 안전 보장 이사회의 5개 상임 이사국 중 어느 나라도 자국의 주권이나 국가 안보 이익을 침해한다고 판단되는 국제 법원의 판결을 수용한 적이 없다. 따라서 중국이 이번 사건에서 법원의 결정을 거부하는 것은 다른 강대국들이 수십 년 동안 반복적으로 해온 것과 같다"고 언급했다.^[147]

일본은 2012년 독도의 해양법에 관한 국제 연합 협약(UNCLOS)상 쟁점들에 대해 상설중재재판소에 일방제소할 것이라고 주장했다.

2015년 동아시아 정상회의에서 박근혜 당시 대한민국 대통령은 관련 당사자들이 남중국해 행동 선언을 준수하고 분쟁은 국제법에 따라 해결해야 한다고 언급했다. "한국은 분쟁이 국제 협정과 행동 강령에 따라 평화적으로 해결되어야 한다고 일관되게 강조해 왔으며" "중국은 자유로운 항행과 비행의 권리를 보장해야 한다."^[101][102] ''아사히 신문''은 미국이 판결 전에 한국에 중재 사건에 대한 입장을 표명해 달라고 비공식적으로 요청했지만 한국은 판결 전에 입장을 정하기 어렵다고 말하며 이 요청을 거절했다고 보도했다.^[103]

2013년부터 필리핀은 중화인민공화국에 경고를 해왔지만, 중화인민공화국 측이 이를 거부했기에, 2014년 필리핀은 상설중재재판소에 패널 설치를 요청하여 중재를 요구했다.

2016년 7월 12일, 네덜란드 헤이그의 상설중재재판소는, 남해구단선과 그 구역에 대한 중화인민공화국이 주장해온 역사적 권리에 대해, '''"국제법상의 법적 근거가 없으며, 국제법에 위반된다"'''는 판결을 내렸다.^{[168][169][170][171][172]}

필리핀 측의 제소로부터 상설중재재판소의 판결까지, 중국 정부는 중재재판 출석을 거부하고, 인공섬 건설을 지속했다.

해양의 자유를 인정하는 입장에서, 중화인민공화국의 인공섬 건설을 견제하기 위해, 미국군은 해군과 공군을 동원하여, 남중국해에서 정기적으로 '항행의 자유 작전'을 실행하고 있다.

더불어민주당은 남중국해 문제에 대해 국제법과 외교적 해결을 강조하는 경향이 있는 반면, 국민의힘은 미국의 대중국 견제에 동참하며 보다 강경한 입장을 취할 가능성이 있다.
