2023년 4월 26일, 유럽 집행위원회는 EU 재정 프레임워크 개혁을 위한 세 가지 입법 제안을 제시했다.[52] 제안된 개혁은 공공 부채의 지속 가능성을 강화하고, 개혁 및 투자를 통해 지속 가능하고 포용적인 성장을 촉진하며, 재정 계획 및 재정 수정에 대한 국가의 주인의식을 높이고, 법적 프레임워크를 단순화하며, 예산 정책에 대한 보다 중장기적인 접근 방식으로 전환하고, 재정 규칙의 보다 효과적이고 일관성 있는 시행을 보장하는 것을 목표로 한다.[52]

유럽 중앙 은행(ECB)의 법적 평가에 따르면, 집행위원회의 개혁 제안은 또한 유럽 재정 협약(TSCG)의 제목 III 조항을 통합하는 것을 목표로 하며, 조항이 다를 경우, 이는 TSCG의 후속 개정 또는 폐지를 필요로 하지 않는다. 왜냐하면 TSCG 제2조는 TSCG 조항이 항상 적용되고 기존의 유럽 연합 경제 거버넌스 프레임워크에 따라 해석되도록 보장하기 때문이다.[53]

2024년 2월, 공동 입법자 간의 3자 회담 협상이 SGP 규칙에 대한 포괄적인 개혁에 대한 위원회 제안에 대한 잠정적인 정치적 합의로 끝났다. 개혁은 SGP의 적자 및 부채 한도를 준수하기 위한 보다 완만한 조정 경로를 허용하고, 특정 개혁 요구 사항이 준수될 경우 과도한 적자 절차의 최대 기간을 4년에서 7년으로 연장할 것이다. 새로운 개정된 규칙은 유럽 의회와 각료 이사회에서 2024년 유럽 의회 선거 전에 최종적으로 채택될 것이며, 2025년 예산 초안부터 완전히 적용될 것이다.[54][55][56] 새로운 개정된 재정 규칙에 따라 이끌어지는 첫 번째 ''"국가 중장기 재정 구조 계획"''은 2025-2028년의 4년 기간을 다루며, 각 회원국은 2024년 9월 20일까지 제출해야 한다.[57]

유럽 의회는 2024년 4월에 예방 조치에 대한 새로운 규정에 대한 투표를 할 것으로 예상된다. 의회의 승인을 거쳐, 각료 이사회는 새로운 규정을 채택하고, 교정 조치를 개정하는 규정을 채택하며, 국가 예산 프레임워크에 관한 지침을 개정하는 지침을 채택할 것으로 예상된다. 한편, 새로운 법적 프레임워크가 아직 마련되지 않았기 때문에, 2024년 봄에도 현재의 법적 프레임워크가 계속 적용된다.[52]

2. 5. 1. SGP 개혁의 주요 내용

개혁은 2024년 4월 30일에 채택되어 발효되었으며, SGP에 다음과 같은 변화를 가져왔다.[58][72]

  • 매년 9월 20일까지 제출되는 ''"국가 중기 재정 구조 계획"''은 이전의 매년 4월에 제출되었던 "안정성/수렴 프로그램"과 "국가 개혁 프로그램"을 통합하고 대체한다. 프로그램/계획의 기간에 대해 4~5년의 기간을 유지하면서, 새로운 계획은 이후의 연간 보고가 원래 계획의 실행이 어떻게 진행되고 있는지에 대한 진행 보고서로 제한될 의도로 한다.
  • 특정 개혁 요건이 충족될 경우 과도한 적자 절차(EDP)의 최대 기간은 SGP의 적자 및 부채 한도를 준수하기 위해 더 느린 조정 경로가 필요한 회원국에 대해 4년에서 7년으로 연장될 것이다.
  • 새로운 부채 감축 규칙(규정 1177/2011) - 부채 감축 벤치마크라고도 알려진 이 규칙은 폐지될 것이다. 향후 부채 기반 EDP는 예산 균형 적자와 함께 GDP 대비 부채 비율이 60%를 초과하는 회원국에 대해서만, 동시에 해당 회원국의 통제 계정이 국가별로 합의된 ''"순 지출 경로"''에서 연간 GDP의 0.3% 또는 누적 GDP의 0.6%만큼 벗어나는 경우에만 발동될 수 있다.
  • SGP의 예방적 조치 내의 중기 예산 목표(MTO)와 관련된 ''"중대한 이탈 절차"''는 모두 폐지된다.
  • 재정 감시는 더 이상 구조적 예산 균형의 성과에 초점을 맞추지 않고, 대신 회원국의 ''"국가 재정 순 1차 지출"''의 연간 변화율이 이사회가 승인한 국가별 다년 순 지출 경로 내에 있는지 확인한다.
  • 이전의 "일반 탈출 조항"은 개혁으로 변경되지 않았다. 그러나 이 조항의 활성화/비활성화는 전체 유로존/EU를 전체 엔티티로 다루었기 때문에, 개혁은 또한 "국가 탈출 조항"을 도입했으며, 이는 회원국의 요청과 유럽 위원회의 권고에 따라 이사회가 활성화할 수 있다.

안정과 성장에 관한 협약은 예외적이고 일시적인 상황에서는 3% 적자 기준을 초과하는 것을 허용한다. 60% 부채 기준은 "충분히 감소하는" 경우, 즉 과거 3년 또는 미래 3년 동안 연평균 1%p 이상 감소하는 경우 준수하는 것으로 간주된다.

유럽 연합 회원국들은 안정과 성장에 관한 협약(SGP)의 적자 및 부채 기준을 장기적으로 준수하기 위해 2005년 3월 SGP 개혁 이후 각 국가별 중기 예산 목표(MTO)를 달성하기 위해 노력해 왔다.[79] MTO는 중기적으로 각 연도에 대해 구조적 균형이 국내총생산(GDP) 대비 같거나 커야 하는 한계이다. 각 국가는 자체 MTO를 선택하지만, 장기적으로 정부 계정의 지속 가능성을 보장하는 계산된 최소 요구 사항(최소 MTO)과 같거나 더 나아야 한다.[79]

"국가별로 선택된 MTO"가 준수해야 하는 "최소 MTO"는 다음 세 가지 제한 사항 중 가장 엄격한 것과 같다:[79]

# MTOMB (최소 벤치마크, 경제 침체기 동안 3% 한도를 준수하기 위해 공공 예산 안전 여유를 추가함)

# MTOILD (잠재 부채 및 부채를 고려하여 공공 예산의 장기적인 지속 가능성을 보장하는 최소값으로, 고령화 인구의 예상 예산 영향을 적절히 고려하여 60% 미만의 신중한 수준으로 부채 비율의 장기적 수렴을 보장하는 것을 목표로 함)

# MTOea/erm2/fc (유로존 국가 또는 ERM2 회원에 적용되는 -1.0% 한도, 재정 협약 제3조를 비준하고 구속력 있는 수용을 통해 더 엄격한 요구 사항을 약속한 경우, GDP 대비 부채 비율이 60%를 초과할 때마다 -0.5% 한도로 대체)

재정 협약을 비준하고 제3조의 재정 규정에 구속되는 EU 회원국(유로존 비회원국에 대한 특별한 추가 의향서가 필요함)은 GDP의 구조적 적자가 최대 1.0%를 초과하지 않는 MTO를 선택해야 한다. GDP 대비 부채 비율이 60%보다 훨씬 낮은 경우, 그리고 GDP 대비 부채 비율이 60%를 초과하는 경우 최대 0.5%이다.[79][80]

3. 3. 새로운 부채 감축 규칙 (2011년 규정, 2024년 폐지)

4. 회원국별 SGP 기준 준수 현황

유럽 위원회는 매년 유럽 연합 회원국의 안정과 성장에 관한 협약(SGP) 기준 준수 여부를 평가한다.[60] 1998년부터 모든 회원국에 대해 연간 최소 1회의 일반 점검이 실시되었으며, 2013년 투팩 개혁 발효 이후 모든 유로존 회원국에 대해 연간 최소 2회의 일반 점검이 실시되었다.[60]

2020년부터 2023년까지는 코로나19 팬데믹[62]과 러시아의 우크라이나 침공으로 인한 에너지 가격 상승 및 국방 지출 증가[63] 등 예외적인 상황으로 인해 일반 예외 조항이 발동되어 재정 규칙이 일시 중단되었다.[62][63] 이러한 상황에서도 루마니아는 2019 회계 연도의 적자 한도 위반으로 인해 2020년 4월 과도한 적자 절차(EDP)가 개시되었다.[64][65]

2024년 6월부터 재정 규칙이 재적용되며, 2023년 재정 결과와 2024년 예산을 기준으로 적자 기준 위반 여부만 평가된다.[72][12][13] 이는 2024년에는 부채 한도 또는 부채 감소 위반으로 인한 EDP 개시가 불가능하기 때문이다.[73] 유럽 연합 집행위원회는 경제 성장을 위태롭게 할 수 있는 과도한 재정적 노력을 피하기 위해 부채 감소 벤치마크 준수를 유예했다.[74]

2023년 재정 결과를 기준으로, 2024년 4월 유로스타트 발표에 따르면 10개 회원국(벨기에, 체코, 프랑스, 헝가리, 이탈리아, 몰타, 폴란드, 루마니아, 슬로바키아, 스페인)이 적자 기준을 위반했다.[66] 유럽 연합 집행위원회는 각 회원국이 제출한 안정 프로그램 또는 수렴 프로그램을 검토하여 EDP 개시 여부를 결정할 예정이다.[13]

유럽 연합 집행위원회는 2024년 6월 19일에 제126조(3)항 평가 보고서를 발표하여 각국의 SGP 기준 준수 여부에 대한 최종 평가를 내릴 예정이다.[72] 이 보고서에서는 "명백한 위반"이 "실제"인지 또는 "면제"될 수 있는지를 조사한다.[72] 만약 위반이 면제되지 않으면, 이사회는 7월에 EDP를 공식적으로 채택하고 개시할 것으로 예상된다.[77]

5. 비판

안정과 성장에 관한 협약(SGP)은 여러 측면에서 비판을 받고 있다.

우선, 협약의 경직성이 문제로 지적된다. 경기 침체 시 국가별 경제 상황을 고려하지 않고 일률적인 기준을 적용하여 재정 정책 운용의 유연성을 제약한다는 것이다.[443] 특히, 유로존 국가들은 ECB에 의해 조정되는 통화 정책 변화로 경제 충격에 대응할 수 없기 때문에, 정부 지출, 즉 재정 정책을 통해 충격을 흡수해야 한다.[443] 따라서 경기 침체기에 정부 지출 능력을 제한하는 것은 경기 침체를 심화시키고 성장을 저해할 수 있다는 우려가 제기된다.[443] 반면, 협약이 지나치게 유연하다는 비판도 존재한다.[444]

또한, 협약의 민주적 정당성 문제도 제기된다. 국가 정책 입안자들은 민주적으로 선출되지만, 중앙 감시 기구인 EU는 간접적인 방식으로만 영향을 미친다는 점에서 민주적 적자 문제가 발생한다.[51] 이는 경제적 어려움 시기에 예산 통합 요구가 강해지면서 더욱 뚜렷하게 나타난다.

협약 적용의 불공정성 역시 비판의 대상이다. 프랑스와 독일 등 경제 대국에 대해서는 제재가 제대로 적용되지 않는 반면, 포르투갈(2002년)과 그리스(2005년) 등 소규모 국가에는 엄격하게 적용된다는 것이다.[447] 실제로 이사회는 3% 규칙을 위반한 최초의 두 국가인 프랑스와 독일에 제재를 적용하지 못했다.[447] 로마노 프로디 유럽 연합 집행위원회 위원장(1999–2004)은 이를 "멍청하다"고 묘사하기도 했다.[446]

마지막으로, 협약의 복잡성이 증가하면서 회원국이 절차적 결과를 예측하기 어려워졌다는 문제도 있다.[50] 개혁 과정에서 평가 기준이 복잡해져 혼란을 야기한다는 것이다.
