3. 1. 보험 가입 의무화

개인 의무 가입 조항은 모든 사람이 보험에 가입하거나 벌금을 내도록 요구했다. 개인 의무 가입 조항과 가입 기간 제한은 보험 사망 나선형을 방지하고, 무임승차 문제를 최소화하며, 의료 시스템이 역선택에 굴복하는 것을 막기 위해 설계되었다.

개인 의무 가입 조항은 보험 가입 인구의 규모와 다양성을 증가시키기 위해 고안되었으며, 더 많은 젊고 건강한 가입자를 포함시켜 위험 풀을 넓히고 비용을 분산시키도록 했다.[25]

개인 의무 가입 조항의 적용을 받지 않는 그룹은 다음과 같다.

2017년 감세 및 고용법[26]은 2019년부터 개인 의무 가입 조항을 준수하지 않을 경우 부과되는 벌금을 0달러로 설정했다.[27]

3. 4. 저소득층 지원

하지만 2012년 연방 대법원 판결로 주 정부는 메디케이드 확대를 거부할 수 있게 되었다. 2021년 6월 18일, 텍사스주 등은 오바마케어 무효 소송을 제기했으나, 미국 연방 대법원은 원고의 주장을 기각하고 오바마케어 존속 판결을 내렸다. 대법원은 오바마케어에 벌금이 없으므로 원고에게 손해가 없다고 판단했다.[449]

3. 6. 기타

50인 이상 고용주는 정규직 직원에게 건강보험을 제공해야 하며, 이를 제공하지 않을 시 벌금이 부과된다.[416][417] 2013년 7월, 세입청은 이 조항을 1년 연기한다고 발표했다.[418] 메디케어 지불 제도는 성과급 제도에서 포괄 지불 제도로 변경되었으며, 이에 따라 의료 기관은 더욱 강화된 경영 노력이 요구된다.[413][414]

3. 7. 정치적 논란

2000년대에 들어서면서 의료가 고도화되고 보험료도 비싸졌다. 국민 6명 중 1명이 의료 보험에 가입하지 못하는 상황이 되면서 문제는 심각해졌다. 파산의 원인이 의료비 지불에 기인하는 경우도 드물지 않았다.[430] 2010년 3월, 버락 오바마 대통령은 선거 공약을 실현하는 형태로 오바마케어 법을 성립시켰다. 저소득층에 보조를 함으로써 국민의 건강 보험 가입률을 획기적으로 향상시키는 내용이었다. 그러나 주민으로부터 보험료를 강제 징수하고, 2014년까지 보험 가입을 의무화하지 않으면 메디케어 급여를 중단한다는 점에 대해 각 주가 반발했다. 26개 주가 연방 정부를 제소했고, 2011년 1월 31일에는 플로리다주에서 법률에 대한 위헌 판결이 내려져 보험 제도의 실효성이 의문시되었다.[431]

보조금은 선지급 가능한 환급 가능한 세금 공제 형태로 제공되며, 거래소에서 두 번째로 저렴한 실버 플랜(SCLSP)의 보험료를 소득의 일정 비율로 줄여줍니다. 이 비율은 가구의 연방 빈곤선(FPL) 비율에 따라 달라지며, 2019년에는 소득의 2.08%(100%-133% FPL)에서 9.86%(300%-400% FPL)까지였습니다.
