2. 정의

전시 성폭력은 전쟁이나 무력 분쟁 상황에서 발생하는 모든 형태의 성적 폭력을 의미한다.[4] 전시 성폭력에 대한 합의된 정의는 존재하지 않지만,[4] 국제형사재판소가 적용하는 로마 규정은 강간을 다음과 같이 정의한다.

"침범"(invasion)이라는 개념은 성중립적으로 광범위한 표현으로, 피해자가 자연적이나 유도적, 또는 나이 관련한 여러 불항거적 이유로 진정으로 동의를 할 수 없는 상황을 전부 포함하는 개념이다.[487]

국제형사재판소의 로마 규정 제7조에서는 "인도에 반하는 죄" 속에 "강간, 성적 노예, 강제 매춘, 강요된 임신 상태의 지속, 강제 단종 및 기타 모든 형태의 성적 폭력"도 포함되어 있다.[462]

2009년, UN은 분쟁 관련 성폭력(CRSV)을 평화와 안전 문제 및 관련 위반으로 다루기 위한 권한을 확립하고, 전시 성폭력의 정의를 "강간, 성적 노예제, 강제 매춘, 강제 임신, 강제 낙태, 강제 불임 수술, 강제 결혼, 성폭력, 착취를 목적으로 분쟁 하에서 행해진 인신 매매, 그리고 여성, 남성, 소녀, 소년을 대상으로 행해지고 분쟁과 직접적 또는 간접적으로 관련되어 있는 동등한 심각성의 폭력"이라고 정의했다.[464]

3. 원인

전시 성폭력은 복합적인 요인에 의해 발생한다. 전쟁 상황은 법과 질서가 무너지고, 폭력 문화[314] 혹은 무력감 문화[315]를 조성하여 민간인에 대한 인권 침해 및 처벌 의식이 희미해지는 효과를 가져올 수 있다.[485][488] 군대의 기강 해이, 부족한 군비, 약탈을 승리의 보상으로 여기는 인식 등이 전시 성폭력의 원인이 될 수 있다.[5][318]

인종 청소나 특정 집단에 대한 지배, 굴욕, 공포를 심어주기 위한 전쟁 전술로 전시 성폭력이 사용되기도 한다.[489][490] 2008년 유엔 안전보장이사회는 여성과 소녀들이 특히 성폭력의 표적이 되는데, 이는 공동체나 민족 집단의 민간인 구성원을 모욕하고 지배하며 두려움을 심어주고 분산시키거나 강제 이주를 위한 전쟁 전술 중 하나로 강간을 이용하기 때문이라고 밝혔다.[320]

4. 역사

고대 그리스인은 여성에 대한 전쟁 강간을 "전쟁 규칙의 범위 내에서 사회적으로 허용되는 행위"로 간주했으며, 전사들은 정복한 땅의 여성을 "정당한 전리품"으로 간주했다.[330]

바이킹은 8세기 후반부터 11세기 초에 걸쳐 유럽의 넓은 지역을 습격하고 지배했지만, 점령지에서는 강간과 약탈이 행해졌다고 여겨진다.

중세 유럽에서는 병사가 여성과 민간인을 일반적으로 공격하는 것을 억제하는 Peace_and_Truce_of_God영어의 제도와 기사도의 이상을 넓혀 전시 성폭력을 막으려 했다[465]。이 시대는 전쟁에서 이긴 것에 대한 보상으로 행해졌고, 여전히 성폭력이 만연했다. 30년 전쟁에서는 다수의 독일인이 약탈의 피해를 입었을 뿐만 아니라, 많은 여성들이 강간을 당했다.

제2차 세계 대전 동안 나치 독일, 일본 제국, 소련 등 여러 국가의 군대에 의해 광범위하고 체계적인 성폭력이 자행되었다.[469][470]

뉘른베르크 재판과 극동 국제 군사 재판은 연합국이 추축국의 주요 전쟁 범죄자들을 평화에 대한 죄, 전쟁 범죄, 인도에 반한 죄로 기소하기 위해 설립한 국제 재판소였다. 1899년과 1907년 헤이그 협약에 의거, 성폭력을 전쟁 범죄로 기소할 가능성이 있었으나, 뉘른베르크 재판소는 나치 전쟁 범죄자들을 강간 혐의로 기소하지 않았다. 하지만, 홀로코스트 당시 성폭력 피해자들의 증언이 있었다.[20] 기록에 따르면 최소 34,140명의 유럽 여성들이 독일 점령 기간 동안 강제로 매춘에 종사했으며, 강제 수용소 여성 수감자들도 포함되었다.[22] 소녀와 여성들은 독일 순찰 중 점령된 도시의 거리에서 납치되기도 하였다.[23][24][25]

극동 국제 군사 재판소는 일본 장교들에게 난징 대학살에서 "강간을 막지 못한 죄"를 유죄로 판결했다.[26][27] 검찰에 따르면, 일본이 난징을 점령한 첫 몇 주 동안 2만 명 이상의 여성과 소녀들이 강간당했다. 도쿄 전쟁 범죄 재판소는 재판 증언과 공공 기록에 성폭력 범죄에 대한 설명을 포함했다.[28] 국가 차원에서, 제14방면군 사령관 야마시타 도모유키는 "그의 지휘 하에서 강간"을 포함한 혐의로 유죄 판결을 받았다.[28] 약 35명의 네덜란드 위안부가 1948년 바타비아 군사 재판소에 성공적으로 소송을 제기했다.[28]

"위안부"는 제2차 세계 대전 중 일본군 군대 위안소에서 성 노예로 강제 징용된 여성들을 완곡하게 이르는 말이다. 주로 한국, 중국, 베트남, 버마, 일본, 대만, 필리핀 여성들이었으며, 그 수는 약 20만 명으로 추정된다.[178][179] 주오 대학의 요시미 요시아키 교수는 최대 20만 명의 일본, 중국, 한국, 필리핀, 대만, 버마, 인도네시아, 티모르, 파푸아, 미크로네시아, 네덜란드, 호주 여성이 수용되어 성 노예로 이용된 약 2,000개의 센터가 있었다고 진술한다.[180]

난징 대학살에서 일본군은 1937년 12월 13일 일본군에 함락되었을 때 난징에 갇힌 중국 여성들을 성폭행했다. 극동 국제 군사 재판에서는 점령 첫 달 동안 20,000명의 여성과 어린이가 강간당하거나 다른 방식으로 성폭행을 당했다고 추정했다.[183] 아이리스 장은 일본군에 의해 강간당한 중국 여성의 수가 20,000명에서 80,000명에 달한다고 추정했다.[184]

일본은 베트남, 버마, 인도네시아, 태국, 필리핀 여성들을 위안부로 강제 징용했다.[185] 자바에서 일본군은 자바 소녀들을 위안부로 대대적으로 모집하여 인도네시아 외 뉴기니, 말레이시아, 태국 및 기타 지역으로 데려갔다.[192] 뉴기니 출신의 멜라네시아 여성들도 위안부로 사용되었다.[200]

제2차 세계 대전 중과 이후에 독일 여성들을 상대로 잔혹한 대량 강간이 자행되었다. 베를린 전투 중과 이후에 10만 명 이상의 여성들이 소련군에 의해 강간당했다는 추산도 있다.[29] 역사가들은 총 2백만 명 이상의 독일 여성이 강간당했다고 추산한다.[30]

전쟁 중 연합국 국민을 상대로도 강간이 자행되었다. 마로키나테는 제2차 세계 대전 중 몬테카시노 전투 이후 알퐁스 쥐앵 프랑스 원정군 식민군인 모로코 구미에에 의한 이탈리아 민간인 대량 강간 및 살해를 지칭하는 용어이다. 2,000명의 여성과 600명의 남성이 강간당했으며, 이러한 범죄의 대부분은 나폴리와 로마 사이의 농촌 지역에서 발생했다.[31]

4. 2. 제2차 세계 대전 이후

1949년 제네바 협약은 전시 강간 및 강제 매춘을 명시적으로 금지했다.[9] 제네바 협약 공통 제3조는 비국제적 분쟁에서 전투 불능이거나 직접적인 적대 행위에 참여하지 않는 사람들에 대한 "생명 및 신체에 대한 폭력"과 "인적 존엄성에 대한 모욕, 특히 굴욕적이고 비하적인 대우"를 금지한다.[9] 제4 제네바 협약 제27조는 국제적 분쟁에서 보호 대상자에 대한 전시 강간 및 강제 매춘을 명시적으로 금지하고 있다. 1977년 추가 의정서 I 및 II에 의해 강화되었다.[9]

1990년대 유고슬라비아 전쟁과 르완다 집단 학살을 계기로 국제사회는 전시 성폭력 문제에 대한 인식을 높였다. 1993년, 구 유고슬라비아 국제형사재판소(ICTY)는 제네바 협약과 전쟁 관습 위반에 근거하여 강간을 반인도적 범죄로 처음 인식하고 체포 영장을 발부했다.[37] 포차(Foča)의 무슬림 여성들이 보스니아계 세르비아인 군인, 경찰, 준군사 단체의 구성원들에 의해 조직적이고 광범위한 집단 강간, 고문 및 성적 노예화를 당했다는 사실이 인정되었다.[37] 2001년 구 유고슬라비아 국제형사재판소는 강간과 성적 노예화를 반인도적 범죄로 인정하는 판결을 내렸다.[38]

1998년, 국제 형사 재판소 르완다(ICTR)는 장-폴 아카예수(Jean-Paul Akayesu) 르완다 타바 코뮌 시장의 재판에서 강간을 집단 학살의 한 형태로 정의하는 획기적인 결정을 내렸다.[34] 재판부는 성폭력이 투치족 집단을 파괴하는 과정의 필수적인 부분이었으며, 강간은 조직적이었고 투치 여성만을 대상으로 자행되었으며, 이러한 행위가 집단 학살을 구성하는 데 필요한 특정한 의도를 나타냈다고 판결했다.[34] 나바네템 필레이 판사는 "강간이 더 이상 전쟁의 전리품이 아니"라는 강력한 메시지를 전달했다.[35] 1994년 르완다 집단 학살 동안 약 50만 명의 여성이 강간당했다.[36]

21세기에도 시리아 내전, 콩고 민주 공화국 분쟁,[44] 예멘 분쟁[45][46], 야지디 학살에서 ISIS의 여성 폭력[47], 2023년 하마스의 이스라엘 공격에서 하마스의 성폭력[48][49][50], 가자 지구 이스라엘 침공에서 이스라엘 방위군의 팔레스타인 여성, 소녀에 대한 인권 침해[52] 등 여러 분쟁에서 여성에 대한 성폭력이 주요 문제로 남아 있다. 2022년 러시아의 우크라이나 침공에서 러시아군은 전쟁의 무기로서 집단 강간의 이용을 포함한 성폭력을 저질렀다. 우크라이나 독립 국제 조사 위원회에 따르면, 러시아 병사에 의한 성적 폭행 피해자는 4세부터 80세까지 광범위하다[476][477][478]

특정 정부가 수감자를 상습적으로 성폭행하기 위해 운영하는 시설을 강간 수용소라고 한다. 보스니아 전쟁 기간에 세르브인계 정부가 운영한 강간 수용소가 대표적인 사례이다.[491][492] 포차 강간수용소 및 포차에 위치한 카라만의 집,[492] 케라테름 수용소, 루카 수용소 등이 이에 해당한다. 강간 캠프는 국가 또는 비국가, 무장 또는 민간, 조직 구조의 통제 및 권한 하에 구금된 사람들이 체계적이고 반복적으로 강간당하도록 설계되거나 그렇게 되는 구금 시설이다.[452]

방글라데시 독립 전쟁 중, 파키스탄군은 집단학살의 일환으로 육군 캠프를 강간 캠프로 사용했다.[450][451] 오스트레일리아 출신 의사이자 낙태 전문의인 제프리 데이비스는 비나 D'코스타와의 인터뷰에서 파키스탄군이 병원과 학교에 포격을 가하고, 성적으로 성숙한 여성들을 격리하여 군대를 위해 마련된 구역으로 데려갔다고 말했다.[450]

티그라이 전쟁 중 성폭력에는 세 곳의 강간 수용소가 있었다. 에티오피아 국방군(ENDF)이 설치하고 ENDF 및 에리트레아 방위군(EDF)의 강간범들이 있던 하우젠의 강간 수용소, 강간범들이 차례로 피해자의 아기를 안고 있던 공사 현장의 ENDF–EDF 강간 수용소, 강가 옆의 세 번째 강간 수용소가 그곳이다.

5. 3. 전시 성매매 강요 및 성노예

강제 성매매나 성노예는 군인의 여성 포로에 대한 기회주의적 강간 그 이상의 것을 포함하며, 특정 여성 및 소녀를 장기간 성노예로 강제 동원하는 것을 의미한다. 유엔에서는 이를 "강간이나 다른 형태의 성폭력을 통한 성적 접근 권리를 포함한 인간의 소유권의 일부 또는 전부를 자유롭게 행사하는 자의 상태나 그 지위"로 정의한다.[493][454] 전시 강제 성매매는 무장세력에 의한 개인 단위의 밀거래에서부터 군이나 민사 정부의 제도화된 강간행위에까지 여러 형태를 취하고 있다. "성매매 강요"(forced prostitution)는 언론에서 생존을 위해 실향하여 매춘을 강요받고 있는 사람에게 지칭하여 사용하기도 한다.[494][455]

전쟁 강간 피해자의 신체적 부상은 외상, 성병, 산모 사망률, 원치 않는 임신, 안전하지 않은 낙태, 지속적인 부인과 문제 등으로 심각하게 나타난다.[340] 분쟁 지역에서는 응급 피임, 항생제, 낙태에 대한 접근이 제한적이기 때문에 인간 면역 결핍 바이러스(HIV) 감염도 드물지 않게 발생한다.[341] 어떤 경우에는 여성들이 병에 걸릴 위험에 대한 군인들의 조롱을 받기도 했다.[342]

전쟁 강간에는 남성 생식기에 대한 신체적 강간이 포함될 수 있다.[343] 집단 강간과 주먹, 막대기, 봉, 총열과 같은 물체를 이용한 강간은 요실금 및 질루(질 누공)을 유발할 수 있다.[408] 질루는 질에 결장(항문 또는 직장) 또는 방광과 인접한 구멍이 있는 질환으로, 여성 할례[345](FGM) 및 강간의 결과로 발생하기도 한다.[344] 폭력적인 강간은 질벽이 찢어지거나 뚫려 심한 통증과 쇠약성 요실금(비뇨기 합병증) 및 장 기능 억제를 초래하며,[408] 여성 생식기와 산도에 구멍이 생기는 산과 누공의 원인이 되기도 한다.[346]

신체적 영향으로는 허리 골절 및 두개골 균열과 같은 골절로 인한 미래의 장애, 시각 및 청력 손상, 정신적 무능력 등이 발생할 수 있다.
