1990년 이라크의 쿠웨이트 침공 이후, 유엔 안전보장이사회는 678호 결의안을 채택하여 회원국들이 이라크군을 철수시키기 위해 "필요한 모든 수단을 사용할 것"을 승인했다. 678호 결의안은 폐지되지 않았고, 이라크는 이후 쿠웨이트를 침공하거나 위협하지 않았다.

2003년 이라크 침공 당시 미군은 30만 발 이상의 열화우라늄탄을 발사했으며, 이 중 상당수는 사마와, 나시리야, 바스라 등 이라크 주거 지역 인근에서 발사되었다. 미군은 네덜란드 국방부에 열화우라늄탄 발사 위치의 GPS 좌표, 표적 목록, 발사 수량을 제공했으며, 네덜란드 국방부는 정보공개법에 따라 이 자료를 네덜란드 평화단체 팍스(Pax)에 공개했다.[137][138]

6. 1. 이라크의 혼란과 종파 분쟁

미군은 2004년 모술 전투와 제2차 팔루자 전투에서 백린탄과 네이팜탄을 소이탄으로 사용하였다. 2005년 3월, 미 육군이 발행하는 잡지인 야전포병은 팔루자 전투에서 백린탄 사용에 대한 보고서를 발표했다. 영국 국방부는 전쟁 중 미군이 마크 77 폭탄을 사용한 것을 확인했다.[139]

6. 2. 미군의 장기 주둔과 철수

미국이 주도한 연합군은 1991년 걸프 전쟁에서 2천만 개의 소형탄을 포함한 6만 1천 개의 집속탄을 사용했고, 2003년 이라크 침공과 그 이후의 반란 과정에서 2백만 개의 소형탄을 포함한 1만 3천 개의 집속탄을 사용했다.[140][141] 2022년 기준으로 이라크 침공과 이전 전쟁에서 사용된 집속탄, 지뢰 및 기타 미폭발탄 등 수천 개의 미폭발탄이 민간인들에게 여전히 위협이 되고 있다.[142]

6. 3. 국제 사회의 비판과 반성

걸프 전쟁 이후, 미국과 영국은 이라크에 비행금지구역을 설정하고 이를 유지하기 위해 이라크 공군 방공망을 공격했다.[41][42] 그러나 부트로스 부트로스 갈리 전 유엔 사무총장과 위베르 베드린 프랑스 외무장관 등은 이러한 비행금지구역 설정과 공격이 불법이라고 규정했다. 러시아와 중국 등 다른 국가들도 이라크의 주권을 침해하는 행위라며 비난했다.[143][144][145]

2002년 중반, 미국은 이라크 군 지휘 체계를 약화시키기 위해 이라크 남부 지역의 목표물을 신중하게 선택하기 시작했다. 당시 전술 변화는 인정되었지만, 이것이 남부 집중 작전(Operation Southern Focus)의 일환이라는 사실은 공개되지 않았다.

영국 자유민주당이 입수한 정보에 따르면, 2002년 하반기에 영국은 2001년 전체보다 두 배 많은 폭탄을 이라크에 투하했다. 영국은 2002년 3월에 0톤, 4월에 0.3톤의 폭탄을 투하했으나, 5월부터 8월까지는 매달 7~14톤으로 투하량을 늘렸다. 미국 의회가 10월 11일 침공 승인을 하기 전인 9월에는 54.6톤으로 전쟁 전 최고치를 기록했다.

9월 5일에는 100대 이상의 항공기가 이라크 서부의 주요 방공 시설을 공격했다. ''뉴 스테이츠맨''은 이 시설이 시아파 공격을 막기 위한 순찰 지역과는 거리가 멀고, 요르단에서 작전 중인 연합군 특수부대가 이라크에 몰래 진입할 수 있도록 하기 위해 파괴된 것이라고 보도했다.[147]

이라크 침공을 지휘한 토미 프랭크스는 이 폭격이 1991년 걸프 전쟁을 시작한 공습과 같이 이라크 방공망을 약화시키기 위해 계획되었다고 인정했다. 당시 영국 국방장관 제프 훈은 이러한 "활동의 급증"이 이라크 정권에 압력을 가하기 위한 것이라고 말했다. ''타임스''는 "사담 후세인을 자극하여 연합군에게 전쟁 명분을 제공하도록 하기 위한" 것이라고 보도했다. 영국 외무부의 유출된 법률 자문에 따르면, 전쟁을 시작하기 위한 도발로 계획된 이러한 공격은 국제법 위반이었다.[148][149]

2003년 1월 31일 조지 W. 부시와 토니 블레어 간의 회의에서 유출된 메모에 따르면, 부시는 블레어에게 "미국은 유엔 색깔로 칠해진 U-2 정찰기를 전투기 호위와 함께 이라크 상공으로 날리는 것을 고려하고 있다. 사담이 이들을 공격하면 그는 위반하게 될 것"이라고 말했다.[150]
