1959년 쿠바 혁명 이후 쿠바 공산정부는 관타나모 만에 미군이 주둔하는 것을 불법으로 간주하고, 반복적으로 미군기지 반환을 요구했다.[29]

4. 2. 미국 내 법적 공방

미국 대법원은 2004년 ''라술 대 부시''(Rasul v. Bush) 사건에서 관타나모 수감자들이 미국 법원에 인신 보호 영장 청구를 할 권리가 있다고 판결했다.[187] 같은 날, ''함디 대 럼즈펠드''(Hamdi v. Rumsfeld) 사건에서는 미국 시민권자 수감자가 적법 절차에 따라 인신 보호 영장 청구를 할 헌법적 권리가 있다고 판결했다.[189]

2006년 ''함단 대 럼즈펠드''(Hamdan v. Rumsfeld) 사건에서 대법원은 미국 의회가 구금자 처우법을 제정하기 전에 제기된 수감자들의 청원을 심리할 관할권이 있으며, 교전 상태 심사 재판소가 군사 재판 통일법에 제정된 제네바 협약 기준을 위반했다고 판결했다.[201]

5. 수감자

2002년 1월부터 관타나모 수용소에는 총 779명이 수감되었다.[152][153] 수감자들은 아프가니스탄(29%), 사우디아라비아(17%), 예멘(15%), 파키스탄(9%), 알제리(3%) 등 50개 국적 출신이었다.[154]

미국 정부는 이들 대부분이 아프가니스탄 전장에서 체포되었다고 주장했지만, 2006년 세톤 홀 대학교 법학대학원 보고서에 따르면, 수감자의 80% 이상이 미군이 아닌 파키스탄과 아프가니스탄 주민에게 현상금을 받고 넘겨졌다.[118] 미국은 수감자 1인당 5,000달러의 현상금을 제시하는 전단을 배포하기도 했다. 파키스탄 현상금 사냥꾼에게 팔린 중국 위구르족 출신 반체제 인사 아델 누리가 그 예이다.[155]

5. 1. 고가치 수감자

2008년 대선에서 버락 오바마 후보는 관타나모 수용소 폐쇄를 공약으로 내걸었고,[316] 2009년 대통령 당선 후 행정명령을 통해 1년 안에 수용소를 폐쇄하겠다고 밝혔다.[43] 그러나 의회의 반대와 수감자 관련 자료 부족 등으로 인해 폐쇄는 지연되었다.[46][317] 2011년 1월, 오바마 대통령은 수감자 이송 제한 조항이 포함된 국방수권법에 서명하면서 수용소 폐쇄는 더욱 어려워졌다.[45] 결국 오바마 대통령은 임기 내에 수용소를 폐쇄하지 못했지만, 수감자 수는 41명으로 감소했다.[16]

도널드 트럼프 대통령은 수용소 유지를 주장하며, 2018년 1월 수용소를 무기한 유지하는 행정명령에 서명했다.[362] 2021년 조 바이든 대통령은 수용소 폐쇄를 목표로 재검토를 시작했다.[363]

6. 1. 국제사회의 비판

유럽 연합 회원국, 미주 기구, 국제앰네스티, 휴먼 라이츠 워치와 같은 비정부 기구들은 관타나모 수용소 수감자들의 법적 지위와 신체적 조건에 대해 비판해 왔다.[270][271] 휴먼 라이츠 워치는 2003년 세계 보고서에서 부시 행정부가 테러 용의자들을 다루면서 인권 기준을 무시했다고 비판했다. 휴먼 라이츠 워치는 미국이 아프가니스탄 출신 전쟁 포로들에게 제네바 협약을 적용하지 않고, '불법 전투원'이라는 명칭을 미국의 범죄 용의자들에게 잘못 사용했다고 주장했다.[69]

2005년 5월 25일, 국제앰네스티는 연례 보고서를 발표하여 이 시설을 "현 시대의 굴라그"라고 칭했다.[270][271] 스테인 경은 "끔찍한 사법 실패"라고 칭하며, "군대는 심문관, 검사, 변호사, 판사 역할을 수행하며, 사형이 선고되면 처형자 역할도 한다. 재판은 비공개로 진행될 것이다. 공정한 재판을 위한 어떤 보장도 지켜질 필요가 없다."라고 말했다.[272]

2006년 2월, 유엔은 미국에 모든 테러 혐의자를 재판하거나 석방할 것을 촉구하는 보고서를 발표했다.[281] 자의적 구금에 관한 실무 그룹에서 발행한 이 보고서에는 미국 대사가 보고서 초안에 대한 답변으로 구금자에 대한 미국 정부의 입장을 재확인한 내용이 부록으로 포함되어 있다.

유럽 지도자들 또한 이 구금 센터에 대한 반대 입장을 표명했다. 2006년 1월 13일, 독일 총리 앙겔라 메르켈은 관타나모 만에서의 미국의 죄수 구금을 비판했다.[282][283] 영국에서는 북아일랜드 장관 피터 헤인이 관타나모 수용소가 없었으면 좋겠고, 폐쇄되었으면 좋겠다고 말했다. 그의 동료 내각 멤버이자 전 영국 총리 토니 블레어는 다음 날 이 센터가 "변칙적이며 조만간 처리해야 할 문제"라고 말했다.[284]

2007년 5월, 마틴 셰이닌 유엔 대테러 인권 특별 보고관은 유엔 인권 이사회에 대한 예비 보고서를 발표했다. 보고서는 미국이 국제법, 특히 시민적 및 정치적 권리에 관한 국제 규약을 위반했다고 밝혔다.[212]

2023년 6월, 피오눌라 니 아올라인 유엔 인권 및 대테러 특별 보고관은 구금 센터에 대한 최종 보고서를 발표했다. 보고서는 죄수들이 "지속적인 잔혹하고 비인간적이며 굴욕적인 대우"를 견디고 있으며, 구금 센터를 폐쇄해야 한다고 결론지었다.[313][314][315]

6. 2. 폐쇄 시도

2008년 대선에서 버락 오바마는 관타나모만을 "미국 역사에서 슬픈 장"이라고 묘사하고 2009년에 수용소를 폐쇄하겠다고 약속했다.[316] 당선된 후, 오바마는 60분과 ABC 프로그램 This Week에서 대선 공약을 다시 한번 강조했다.[316]

2009년 1월 22일, 오바마는 관타나모만 수감자들의 모든 사건을 검토하여 각 수감자를 기소해야 하는지 여부와 방법을 결정하기 위해 정부에 120일 동안 관타나모만 수감자 기소를 중단하라고 명령했다.[39] 하루 뒤, 오바마는 관타나모 수용소를 1년 안에 폐쇄한다는 행정 명령에 서명했다.[43] 그러나 그의 시도는 의회의 공화당 반대에 의해 대체로 좌절되었다.[363] 그의 계획은 행정부의 새로운 관계자들이 많은 수감자들에 대한 포괄적인 파일이 없다는 것을 발견하면서 차질을 빚었다. 따라서 그들에 대한 이용 가능한 증거를 모으는 것만으로도 몇 주 또는 몇 달이 걸릴 수 있었다.[317] 5월에 오바마는 기소를 재개할 것이라고 발표했다.[318] 2009년 5월 20일, 미국 상원은 2009년 추가 할당법 (H.R. 2346)에 대한 수정안을 통과시켜 관타나모만 수용소에 수감된 수감자의 이송 또는 석방에 필요한 자금 지원을 90-6표로 차단했다.[42] 2009년 11월, 오바마는 자신이 정한 관타나모만 수용소 폐쇄 "구체적인 기한"을 "놓치게" 될 것이라고 인정했다. 그는 수용소가 2010년 후반에 폐쇄될 가능성이 높지만, 구체적인 기한을 정하지는 않았다.[319][320]

오바마는 2009년 12월 15일 자 대통령 각서를 발표하여 구금 시설을 공식적으로 폐쇄하고 수감자를 일리노이주 톰슨에 있는 톰슨 교정 센터 (현재 미국 톰슨 교도소)로 이송하도록 명령했다.[43]

관타나모 심사 태스크 포스는 2010년 1월 22일에 최종 보고서를 발표했지만[250] 그 해 5월 28일에 공개했다.[251] 보고서는 당시 수감자 126명을 본국이나 제3국으로 석방하고, 36명을 연방 법원 또는 군사 위원회에서 기소하며, 48명을 전쟁법에 따라 무기한 구금할 것을 권고했다.[252] 또한, 본국 안보 상황이 개선되면 예멘인 30명을 석방하도록 승인했다.[251]

2011년 1월 7일, 오바마 대통령은 관타나모 수감자의 본토 또는 다른 외국으로의 이송을 제한하는 조항을 포함하는 2011년 국방 권한 법안에 서명하여 구금 시설 폐쇄를 방해했다.[45]

2016년 2월 23일, 오바마는 의회가 수용소 폐쇄에 동의하지 않은 지 수년이 지나 수용소 폐쇄라는 결론에 도달했다고 밝혔다. 수용소 폐쇄의 정확한 기간은 공개되지 않았다.[352] 오바마는 퇴임 전에 수용소를 폐쇄하지 못했지만, 수감자 수를 41명으로 줄였다.[16]

도널드 트럼프 대통령은 이 교도소를 계속 운영하고 테러리스트, 잠재적으로는 ISIS의 미국 지지자들을 수감하는 데 사용할 것을 다짐했다.[361] 2018년 1월 30일, 국정 연설 직전에 트럼프는 이 교도소를 무기한 유지하는 행정 명령에 서명했다.[362]

2021년 2월 11일, 조 바이든 미국 대통령은 수용소를 공식적으로 재검토할 것이라고 발표했으며, 임기 내에 수용소를 폐쇄하는 것을 목표로 삼았다.[363]

2024년 12월, 미국은 2002년 발리 폭탄 테러와 관련된 혐의를 인정하고 주모자에 대한 증언에 동의한 관타나모만에서 말레이시아 수감자 2명을 말레이시아로 이송했다. 또한, 혐의 없이 17년 동안 구금된 케냐 수감자가 송환되었다.[360]
